Long-Term Disability Litigation: ERISA and Non-ERISA Claims

ERISA litigation is very different from litigation of non-ERISA, individual disability insurance claims. Litigation of an ERISA disability insurance claim usually does not involve live testimony by witnesses, and there are no jury trials. The litigation process is best described as an argument based on a review of the insurance company file. A judge’s decision is often based solely on the information that is contained in the insurance company’s claim file. It is important to know that if a piece of evidence is not in the claim file, such as an updated doctor’s report, it will not be seen by the judge. For this reason, you must be sure to submit detailed application forms, doctor’s reports, and other documentary evidence either with your initial application or in the appeals process.
